In Case C-421/24, the Court of Justice addressed when an online platform may lose the hosting liability exemption in connection with gambling-related videos. The Court distinguished neutral hosting from a commercial partnership in which the platform reviews a channel’s theme, leading videos and metadata. Where that review gives the platform specific knowledge and control, it may no longer act as a merely technical, automated and passive intermediary. The national court must apply that test to the facts. The judgment is important for gambling advertisers, affiliates and platforms because contractual cooperation and content review can materially change the liability analysis.

In der Rechtssache C-421/24 hat der Gerichtshof präzisiert, wann eine Online-Plattform im Zusammenhang mit glücksspielbezogenen Videos die Haftungsprivilegierung für Hosting-Dienste verlieren kann. Entscheidend ist die Abgrenzung zwischen neutralem Hosting und einer kommerziellen Partnerschaft, bei der die Plattform Thema, erfolgreiche Videos und Metadaten eines Kanals prüft. Erlangt die Plattform dadurch konkrete Kenntnis und Kontrolle, kann sie nicht mehr nur als technisch-passive Vermittlerin gelten. Die Anwendung auf den Einzelfall bleibt dem nationalen Gericht überlassen. Für Glücksspielwerbung, Affiliates und Plattformverträge ist das Urteil besonders relevant.
